Allegiant E-Sign Terms of Use

These terms govern your use of our electronic signature platform (“E-Sign”). By using E-Sign, you agree to these terms. If you do not agree, do not use the platform.

1. About Us
E-Sign is operated by Allegiant Finance Services Limited. Company No. 07474972. Authorised and regulated by the Financial Conduct Authority (FRN 836810). Address: 400 Chadwick House, Warrington Road, Birchwood Park, Warrington WA3 6AE.

2. What E-Sign Does
E-Sign allows you to electronically sign documents relating to claims we manage on your behalf. It creates a legally valid electronic signature under the Electronic Communications Act 2000 and UK eIDAS Regulation.

3. Your Agreement to Use Electronic Signatures
By using E-Sign, you confirm that:

  • You consent to sign documents electronically
  • You understand an electronic signature has the same legal effect as a handwritten signature
  • You intend to be legally bound by documents you sign through E-Sign
  • You can withdraw consent by contacting us before signing

4. Your Responsibilities
You must:

  • Provide accurate information about yourself
  • Keep your access details secure and not share them
  • Only sign documents you have authority to sign
  • Read documents carefully before signing
  • Tell us immediately if you suspect unauthorised use of your account

5. What You Must Not Do
You must not:

  • Sign documents on behalf of someone else without proper authority
  • Upload malicious software or attempt to compromise E-Sign security
  • Use E-Sign for any unlawful purpose
  • Interfere with the proper working of the platform

6. Audit Trail
E-Sign automatically records information to prove the validity of your signature, including: date and time of signing, your IP address, device information, and the actions you took. This audit trail may be used as evidence in legal proceedings or regulatory matters.

7. Document Storage
Signed documents are stored securely. You can access copies through our client portal. We retain signed documents for 6 years after your claim concludes.

8. Availability
We aim to keep E-Sign available at all times but cannot guarantee uninterrupted access. We may suspend the platform for maintenance, security issues, or circumstances beyond our control. We are not liable for any loss caused by unavailability.

9. Limitation of Liability
To the extent permitted by law:

  • We do not guarantee E-Sign will be error-free or meet your specific requirements
  • We are not liable for indirect, consequential or special losses
  • Our total liability is limited to the fees you have paid us

Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Changes to These Terms
We may update these terms from time to time. Continued use of E-Sign after changes means you accept the updated terms.

11. Governing Law
These terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the English courts.
