Data from the Financial Ombudsman Service for the latter half of 2022 indicates that 51% of complaints concerning Blue Motor Finance were upheld in favor of the customer.
Blue Motor Finance is expected to perform thorough checks to ensure that the financial arrangements are sustainable and affordable for their customers. However, these checks are not always up to par. In ruling on a complaint, an ombudsman stated:
‘Blue Motor Finance should have asked Mr H about his expenditure. Although it did complete a credit check, this won’t have indicated what Mr H’s regular living expenses were. Without knowing what Mr H’s regular committed expenditure was Blue Motor Finance wouldn’t have got a reasonable understanding of whether the agreement was affordable or not. It should be noted that not all customers may possess the necessary funds to meet their monthly obligations to Blue Motor Finance. This could be attributed to an irresponsible lending decision made by Blue Motor Finance. For instance, a customer might lack sufficient disposable income to cover both loan repayments and the associated expenses of car ownership and daily living:
‘Mrs M said she was paying around £433pm to cover food and essential things for the family, she also had to pay for mobile, internet/TV, fuel, utilities. Looking at her outgoings it appeared that Mrs M had more money going out than coming in. Our success fee is due only if your lender makes a compensation payout, and is calculated on the amount of the compensation payout. We do not charge you for any part of a settlement that results in the lender reducing your outstanding balance – that is on the house!
The success fee amount is calculated using a band charging system. There are five charging bands. Each band has a maximum amount that we will charge.
